Who commits the crime of failure to assist at a traffic accident?

Question

DentroTest · Accepted Answer

The crime of failure to assist is based on a lack of human solidarity. According to the Criminal Code and the General Traffic Regulations, anyone who witnesses an accident or is involved in one is obliged to help. However, the rule specifies a key condition: help must be given whenever it can be done without risk to oneself or to third parties. Therefore, the crime is committed by anyone who does not help when able to do so without danger. No crime is committed by someone who does not act because their life is in danger (safety comes first), nor by someone who, physically unable to help, calls the emergency services for help (fulfilling the duty to request help).
