May traffic officers immobilize a vehicle that emits pollutant gases exceeding permitted levels?

Question

DentroTest · Accepted Answer

Yes, that is correct. According to the Traffic and Road Safety Law, law enforcement officers can immobilize a vehicle if it presents deficiencies that constitute a serious risk to road safety or, as in this case, when it exceeds the regulatory limits for gases, smoke, or noise. It is not simply a matter of a warning or a fine; the vehicle can be taken off the road until the technical deficiency causing the excessive pollution is rectified, as it fails to meet the required technical conditions.
