In addition to a positive result, in what other situation may officers immobilize the vehicle during an alcohol test?

Question

DentroTest · Accepted Answer

Vehicle immobilization is a preventive safety measure. Officers will proceed to immobilize the vehicle not only when the driver tests positive (and no other authorized driver is available to take over), but also when the driver refuses to take the alcohol detection tests. The logic is that, upon refusal, officers cannot guarantee that the driver is in a fit psychophysical condition to drive without endangering road safety. Why the other options are incorrect: Nervousness: This is a state of mind, not an infraction or proof of intoxication in itself. Not wearing a seatbelt: This is a serious infraction resulting in a fine and loss of points, but it is not grounds for vehicle immobilization.
