While driving, is the driver responsible for ensuring that passengers maintain the proper position?

Question

DentroTest · Accepted Answer

Yes, the driver is ultimately responsible for safety inside the vehicle. According to the General Traffic Regulations (Article 18), the driver is obliged to maintain their own freedom of movement, necessary field of vision, and permanent attention to driving. To guarantee this, the driver must strictly ensure that they maintain the proper position and that the rest of the passengers do the same, in addition to ensuring the correct placement of transported objects or animals. This means the driver must verify that no one travels in dangerous postures (such as putting feet on the dashboard) or without mandatory restraint systems.
