For the purposes of traffic regulations, is a moped considered a motor vehicle?

Question

DentroTest · Accepted Answer

The correct answer is No. Although mechanically it possesses an engine for self-propulsion, the Traffic Law explicitly excludes the moped from the legal definition of a 'motor vehicle'. It is classified within the category of vehicles but specifically as a 'non-motor' vehicle (similar in certain legal aspects to a tram or vehicle for people with reduced mobility) due to its limited technical characteristics: an engine displacement not exceeding 50 cc (if internal combustion) and a maximum design speed not exceeding 45 km/h. This distinction is fundamental for interpreting road signs: for example, a sign prohibiting entry to 'motor vehicles' would technically allow a moped to pass, unless otherwise indicated.
