On a motorcycle, if the passenger is not wearing a protective helmet, who is responsible for the infringement?

Question

DentroTest · Accepted Answer

The driver of the vehicle is solely responsible. According to the Road Safety Law and the General Traffic Regulations, on motorcycles and mopeds the driver is responsible for ensuring that the passenger wears the protective helmet properly fastened. This differs from passenger cars, where an adult passenger would be responsible for their own failure to wear a seatbelt. On motorcycles, the fine and the possible loss of points fall on the driver, regardless of whether or not the passenger is the owner of the vehicle.
