If the result of a breath alcohol test is negative, can traffic officers require the driver to undergo a second test?

Question

DentroTest · Accepted Answer

The correct answer is yes, but under specific conditions. As a general rule, if the result is negative, a second test is not carried out. However, the Traffic and Road Safety Law establishes an important exception: if, despite testing negative (or below the maximum permitted level), the driver shows obvious symptoms of being under the influence of alcohol (such as slurred speech, smell of alcohol, unsteadiness or erratic behavior), the officers have the authority and the duty to carry out a second test to verify the driver's real condition and guarantee the safety of the road. They could also propose a medical examination or drug detection tests.
