Will the agents proceed to immobilize the vehicle if the driver refuses to take the breathalyzer test?

Question

DentroTest · Accepted Answer

The correct answer is Yes. If a driver refuses to undergo the legally established tests for alcohol detection, the agents will proceed to immobilize the vehicle using a seal or other effective procedure. This preventive safety measure applies to all drivers (not just novice drivers) to avoid risks on the road, unless another properly licensed person can take charge of the vehicle. Furthermore, refusing to take the test can be considered a crime against road safety under the Penal Code.
