If you witness a traffic accident on the road, are you under an obligation to stop to render aid?

Question

DentroTest · Accepted Answer

The correct answer is: Yes, if no help is already present. Detailed explanation: According to the Traffic Law and the Criminal Code (the crime of failure to render aid), any road user who witnesses an accident, or is aware of it, is obliged to help or call for help if the victims are left unattended. However, there are important exceptions for road safety: If help has already been organized: If law enforcement officers or the emergency services are already at the scene, you must not stop, unless your cooperation is expressly requested. Stopping unnecessarily in these cases may cause further accidents or tailbacks (the well-known 'rubbernecking effect'). If stopping creates a greater danger: Help must always be given as long as it can be done without risk to yourself or to third parties. Therefore, 'Yes, always' is wrong because you must not stop if professional help is already acting.
