Can officers perform a second test or additional checks if the result of the first breathalyzer test was negative?

Question

DentroTest · Accepted Answer

Yes. Even if the numerical result of the breathalyzer is negative (below the maximum allowed limit), if the driver displays evident symptoms of being under the influence of alcohol (such as slurred speech, smell of alcohol, lack of coordination, or erratic behavior), officers must act in the interest of road safety. In this case, they may perform a second breath test, subject the driver to a drug test, or transport them to a medical center for a clinical analysis to determine their actual state, as the symptoms indicate an impairment of the psychophysical skills required for driving.
